Collection and Use of Personal Information

Personal information is data that can be used to identify or contact a single person.

Should you choose to order product from us you will be asked to provide some personal information. You are not required to provide this information, but, if you chose not to do so we will not be able to provide you with our products.

What personal information we collect

  • We collect a variety of information including your name, mailing address, phone number, email address and credit card information.

How we use your personal information

  • The personal information we collect allows us to keep you posted on special offers and product announcements. If you don’t want to be on our mailing list, you can opt out anytime by updating your preferences.
  • From time to time, we may use your personal information to send important notices such as communications about purchases and changes to our terms, conditions, and policies. You may not opt out of receiving thesecommunications, however, this information is important to your interaction with us.
  • We may also use personal information for internal purposes such as auditing, data analysis, and research to improve our products, services, and customer communications.

Collection and Use of Non-Personal Information

We also collect data in a form that does not, on its own, permit direct association with any specific individual. We may collect, use, transfer, and disclose non-personal information for any purpose. The following are some examples of non-personal information that we collect and how we may use it:

  • We may collect information such as country and area codes, URL, location, etc. in order to improve our services.
  • We may collect information regarding customer activities on our website, Facebook and the like. This information is aggregated and used to help us provide more useful information to our customers and to understand which parts of our website, products, and services are of most interest. Aggregated data is considered non‑personal information for the purposes of this Privacy Policy.

If we do combine non-personal information with personal information the combined information will be treated as personal information for as long as it remains combined.

Cookies and Other Technologies

Our website and email messages may use “cookies” and other technologies to help us better understand user behaviour, tell us which parts of our websites people have visited, and facilitate and measure the effectiveness of web searches and experience. We treat information collected by cookies and other technologies as non‑personal information. However, to the extent that Internet Protocol (IP) addresses or similar identifiers are considered personal information by local law, we also treat these identifiers as personal information. Similarly, to the extent that non-personal information is combined with personal information, we treat the combined information as personal information for the purposes of this Privacy Policy.

Protection of Personal Information

We take the security of your personal information very seriously and protect your personal information during transit using encryption. Your personal data is stored in encrypted form including when we utilize third-party storage.

Dispatch

Your order will be dispatched as soon as possible, usually the same day if received before 10am (AEST). In the unlikely event of a product shortage or delay we will notify you via the email you have provided.

Returns

Any member of the public purchasing from the website or through a Distributor has a 30 day option to return in good faith any product ordered for a full refund of the product (excluding postage).

PROCEDURE:

  1. Contact the office via: admin@NiOxHealth.com and receive a code that must accompany the product when returned.
  2. Send the product with the code to the Australian Head Office nominated on this site.
  3. We will email you a Return Form which must be fully completed and returned with the product.
  4. Your Refund will be processed within 24 hours of receiving returned product. You will receive an email to confirm your payment has been made.

What do we do with your information?

When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address.

When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.

Email marketing: With your permission, we may send you emails about our store, new products and other updates.

Consent: How do we get your consent?

When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.

If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent or provide you with an opportunity to say no.

How do I withdraw my consent?

If after you opt-in, you change your mind, you may withdraw your consent for us to contact you, for the continued collection, use or disclosure of your information, at any time, by contacting us at admin@NiOxHealth.com.

Disclosure

We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.

Others

It may be necessary − by law, legal process, litigation, and/or requests from public and governmental authorities within or outside your country of residence − for us to disclose your personal information. We may also disclose information about you if we determine that for purposes of national security, law enforcement, or other issues of public importance, disclosure is necessary or appropriate.

We may also disclose information about you if we determine that disclosure is reasonably necessary to enforce our terms and conditions or protect our operations. Additionally, in the event of a re-organization, merger, or sale we may transfer any and all personal information we collect to the relevant third party.

SHOPIFY

Payment

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you. Your data is stored in Shopify’s data storage databases and the general Shopify application. They store your data on a secure server behind a firewall.

If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted. All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands such as Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers. For more insight, you may also want to read Shopify’s Terms of Service.

Third-party services

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us. However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions. For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers. In particular, remember that certain providers may be located in or have facilities that are located in a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located. As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act. Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

Some platforms allow us to collect, organize and use UGC (user-generated content), including, without limitation, any and all material, text, videos, photographs and information or other data (including Reviews, as defined below) submitted by you or on your behalf or your End-Users to Yotpo through the Platform (collectively, “Submitted UGC”). Submitted UGC may include opinions, product or service ratings or reviews, articles, written expressions, in any form or media, Instagram photos and/or any works of authorship created by the End-User, you or any other third party (collectively, “Reviews(s)”) and may, subject to these Terms, include any Reviews that are imported through the Platform from third-party sites (“Imported Reviews”).

OWNERSHIP OF SUBMITTED UGC.

As between you and NiOx Health, all the Intellectual Property Rights (as defined above) in and to the Submitted UGC are the property of NiOx Health and NiOx Health shall retain all right, title and interest in connection therewith. “Intellectual Property Rights” means worldwide (a) rights associated with any patents, patent applications, patent disclosures, industrial designs, inventions and improvements (whether patentable or not), works of authorship, trademarks, service marks, logos, trade names, trade dress and goodwill rights whether or not registered, advertising and promotional material, domain names and web presence, designs and photography including copyrights and copyrightable works (including computer programs) and registrations and applications therefor, any software, algorithms, firmware, or source code, trade secrets, know-how, database rights, drawings and all other forms of intellectual property and all tangible and intangible representations and manifestations of such intellectual property (collectively, “Intellectual Property”); (b) rights analogous to those set forth in subsection (a) and any other proprietary rights relating to intangible property; and (c) divisions, continuations, renewals, reissues and extensions of the foregoing (as applicable) now existing or hereafter filed, issued, or acquired

Security

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed. If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

Changes to this policy

We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it. If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.
